If you keep reading that thread, you notice that the led developer of CC posts and implies that they still own most of the code and assets for CC, and they may take it to Kickstarter to finish the game.
What the... damn... I've had that site bookmarked for a year thinking it was another insta-buy... Damn shame :(

Well, they probably don't actually own any of work they've done. If BitComposer paid for development then they own the code/assets.

On the flip side, that could actually bode well for the future of this project (wishful thinking on my part, most probably, but who knows) - all the parties involved seem to care.
