I would like to know how to get rid of the FPS cap.

No matter what settings the game runs on (640x480@low or 1440x900@recommended=high) I only get 27+/-3 frames and it's really annoying.

It's clearly a FPS cap, not my system (Q6700@2.6GHz, GTX470, 4GB).

Without ubersampling you should be able to reach 60 fps in some areas.
Vertical Sync. Disable it.

HenriqueVT: Vertical Sync. Disable it.
It already is :/

And as I said it also happens when running the game with a resolution of 640x480 and minimal settings (which of course don't include UberSampling).
I m not sure what the problem is then, I usually try to set my game to run around 60 fps without ubersampling but if i disable a few more stuff. its possible to reach 100+ fps so there is definitely no fps limitation if vertical sync is disabled. And my system is a bit faster than yours but not top of the line either.

I'm guessing something is capping your fps. Either 3rd party program or nVIDIA driver settings.

Because 30 fps sounds alot like half of 60 refresh rate.

It's probably just crappy performance and not a cap. Using the new beta drivers, without 3D Vision stuff installed?
Actually the 3D driver makes sense since it halves fps. Uninstalling it should fix it.
Same happens to me with C2D E8400@3.0GHz and Gigabyte GTX460 1GB, 4GB RAM and latest beta/non-beta drivers from nVidia with 3D uninstalled, no matter what settings/resolution I choose I get always 15-30 fps.(no vSync and no ubersampling)

Get a better computer?
I don't think that's an FPS cap, it's more likely that you're being bottlenecked by your processor. Most of the settings (including resolution) have no impact on CPU performance, so short of an upgrade there's little you can do to improve it.

I have the same problem with my E8400 - no amount of turning the graphics settings down helps.

His is a quad core.
Neither of your problems is hardware related...it's widely known to be software (game/drivers).
What version of the game are people having fps problem using? The gog version that I m using doesnt seem to have a problem but I heard other version had a problem with the game not reading the setup file from the correct folder.
