So I am driving to pick up my nephew to go see Avatar, and am just about to go through a 4-way intersection on a green light, with right of way, when some idiot decides to gun it for a late (After the arrow went off) left turn across me heading to my right.
his back left side slams into the front of my fucking BRAND new, completely paid for car, and I get spun 90 degrees to the right, he hits another car, ok?
The airbag goes off, misses me thanks to my Neo-like reflexes, I get shook up all to hell, get out, and see that the ENTIRE front of my car is FUCKED thanks to this idiot.
He ADMITS in front of the police that I had a green light, and acts very apologetic.
So, fault is not going to be an issue, it's on him. HERE is the problem.
I WAS driving a 2007 Toyota Corolla with 30,000 km. The insurance is going to TRY to settle with me for the blue book value, which will NOT allow me to buy the same year of vehicle with the same amout of KM's on it.
Does ANYONE have any advice on dealing with my insurance company/his? Also of note is the fact that I had replacement coverage on my policy, which apparent RAN OUT 2 years in, so 6 months ago. The thing is, I am *pretty* sure they have been charging me the monthy replacement value SINCE then. Replacement coverage means that if my car gets wrecked, no matter what, I get a new 2010 car for example.
I am just ruined by this, it has sent my life into a tailspin. I just started a great new job a month ago with a really cool company, and just as things were looking up, this idiot decides he can't wait one more light to turn left. I also feel sore and stiff, mainly in my neck, back, and jaw. Nothing too serious, but you know how these things go.
If anyone has dealt with anything similar in a country with similar laws to canada, I would appreciate any advice you would have.
PS, Canada does not allow civil damages, IE, no "Pain and suffering".
Do you have bank statements or receipts of you paying that replacement coverage? Show the proof and ask them to back it. Insurance companies boned my family for years and it would be better to do without them anymore, Aflac just took my college money for next year when my dad broke his nose in an accident and we did everything right, papers and all. They still didn't pay it all back like they promised on commercials, they only gave us a little money then shut up while leaving us with bills. Frustrating, and I'm delayed Engineering college another few years at least.
You gotta get rough with the company and tell them to back their promises. Their claims people are paid to give you the least amount of money that you will let them get away with, so don't let them get away with it.
