It only aplies to copies not the original.
4. All software is the private property of the purchaser to do as they will as long as they do not sell or otherwise distribute copies of the software. If purchaser later want's to resell the software (s)he must hand over all backups that have been made and remove software from his/her computer(s).
How does that sound?
Personally I can live with not being able to resell digitally purchased copies IF the price of digitally dispributed copy is lower by about 20% (you don't get retail package, manual or any other physical extra with DD, you can't resell).
